New GR for Small Housing Societies with Less Than 50 Members.

📰 New GR on Managing Committee Structure for Housing Societies with Less Than 50 Members

🔍 Background:

The Maharashtra Governments Department of Cooperation, Marketing, and Textile has issued a revised Government Resolution (GR) that directly impacts Cooperative Housing Societies (CHS) with fewer than 50 members.

Earlier, the composition of the Managing Committee and the number of required members for a valid quorum were based on previous GRs and directives. These have now been superseded and revised under the new resolution dated 28th February 2024, referenced as GR No. SAGRUYO-2024/PR.KR.4/14-S.

⚖️ Key Highlights of the Government Resolution:

1. Managing Committee Size for Smaller Societies:

For housing societies with less than 50 members, the Managing Committee must now consist of only 7 members.

2. Quorum for Committee Meetings:

The minimum quorum required to conduct a valid committee meeting in such societies is 3 members.

3. Legal Provision Applied:

This change has been implemented under the powers conferred by Section 154B-20 of the Maharashtra Cooperative Societies Act, 1960.

4. Effect of the New GR:

  • This GR nullifies and supersedes all previous notifications, circulars, or administrative orders on this matter.
  • Societies falling under this category must now align with the new structure and quorum requirements immediately.

📌 Why This Matters:

This resolution is significant for small cooperative housing societies (with under 50 members), especially in urban areas like Mumbai, Pune, and Nagpur, where such societies are common. The reduced committee size and quorum make it easier for smaller societies to:

  • Conduct meetings efficiently
  • Avoid deadlocks due to non-participation
  • Legally comply with the cooperative law without waiting for larger participation

✅ Implication for Societies:

If your society has fewer than 50 members:

  • Your Managing Committee should comprise exactly 7 members
  • At least 3 members must be present to conduct any official committee meeting
  • You should revise your internal records, society bylaws (if required), and election plans accordingly
