Encroachment of Common Areas in Housing Societies

Bye-Law No. 169(a)

 

All open/common areas intended for the use of all members—such as staircases, steps, landings, parking spaces, lifts, corridors, and other similar spaces—must remain accessible and cannot be occupied by any member for personal use.

These areas are strictly to be used for their designated purposes.

Any member found violating this rule by encroaching on common areas will be subject to the following actions:

  1. Immediate vacation of the encroached space.
  2. Payment of a penalty amounting to five times the monthly maintenance charges for the period of encroachment.

Additionally, members are strictly prohibited from carrying out any unauthorized construction or structural alterations beyond the approved plan without prior approval from the housing society and the concerned municipal or competent authorities.
